Request for Arbitration
As a member of a Board/Association of REALTORS®, you have agreed to arbitrate a commission dispute that you may have. In accordance with Article 17 of the REALTORS® Code of Ethics:
"In the event of contractual disputes or specific non-contractual disputes as defined in Standard of Practice 17-4 between REALTORS® (principals) associated with different firms arising out of their relationship as REALTORS®, the REALTORS® shall submit the dispute to arbitration in accordance with the regulations of their Board or Boards rather than litigate the matter.
In the event clients of REALTORS® wish to arbitrate contractual disputes arising out of real estate transactions, REALTORS® shall arbitrate those disputes in accordance with the regulations of their Board, provided the clients agree to be bound by the decision.
The obligation to participate in arbitration contemplated by this Article includes the obligation of REALTORS® (principals) to cause their firms to arbitrate and be bound by the award."
• A Request for Arbitration form MUST be signed by the BROKER of the firm.
• The claim MUST be filed against the BROKER of the other firm.
• The $500 filing fee must accompany the request along with the statement of facts.
• The settlement MUST have taken place before arbitration can be filed.
• The request MUST be filed within 180 days of settlement.
NOTE: THE BROKER FILING THE CLAIM IS "COMPLAINANT." BROKER THE CLAIM IS AGAINST IS THE "RESPONDENT."
Once a request has been received, it will be reviewed by the Grievance Committee in order to determine if it is an arbitrable matter. If it is forwarded for a formal hearing, both parties will be offered voluntary mediation. If parties do not want to mediate, the process will begin to schedule a formal hearing.
